Terms of Service

These terms govern your use of BestPic (the “Service”), a photo-analysis tool operated by ELU LABS, LLC. By using the website at bestpic.co or the BestPic iOS app, you agree to these terms. If you don't agree, don't use the Service.

What BestPic does

BestPic uses AI to compare photos and suggest which one is most likely to make a strong first impression. Results are generated by a large language model and are subjective. We make no guarantees about outcomes, dating app performance, or social results.

Who can use the Service

  • You must be at least 13 years old.
  • You must have the legal capacity to form a binding contract.
  • You must only upload photos of yourself, or photos you have explicit permission from the subject to upload and analyze.

What you may not do

  • Upload photos of other people without their consent.
  • Upload photos of minors (anyone under 18), except photos of yourself as a minor.
  • Upload illegal, explicit, or harmful content.
  • Attempt to reverse-engineer, scrape, or abuse the Service.
  • Use the Service to build a competing product.

Violations may result in immediate termination of your access without refund.

Paid features and purchases

BestPic offers a free first analysis per device. Additional analyses require either a one-time 24-hour pass or an active monthly subscription. Pricing in U.S. dollars; equivalents in your local currency are shown by Apple at checkout.

  • 24-Hour Pass — $2.99 (one-time).Grants unlimited analyses for 24 hours from the time of purchase. Does not auto-renew. Purchased via Apple's In-App Purchase system on iOS.
  • Unlimited Monthly — $6.99/month (auto-renewing subscription). Grants unlimited analyses while active. Billed monthly to your Apple ID. Renews automatically at the end of each billing period unless canceled at least 24 hours before the period ends. You can manage or cancel at any time in iOS Settings → [Your Name] → Subscriptions. Canceling stops future renewals; you retain access until the end of the current paid period.
  • Web. If purchased via Stripe, the terms of that purchase are described at checkout.

You can restore previous purchases via the Restore button on the paywall or in Settings → Account → Restore purchase. Purchases are tied to the Apple ID used to make them.

Subscription auto-renewal disclosure

By purchasing the Unlimited Monthly subscription, you authorize Apple to charge your Apple ID account $6.99 (USD, or local equivalent) every month, on the same day each month, until you cancel. Apple will notify you before each renewal as required. Cancellation in iOS Settings takes effect at the end of the current billing period; partial-period refunds are not provided. We do not control the timing of Apple's billing, renewal notifications, or cancellation processing.

Refunds

  • iOS purchases (24-Hour Pass and Subscription) are handled by Apple. Request refunds via reportaproblem.apple.com. We are not able to issue refunds for App Store purchases directly; Apple's standard refund policy applies.
  • Web purchases can be refunded within 7 days of purchase by emailing us at hello@elulabs.com, unless the Service has been materially used (multiple analyses completed).

Your content

You retain ownership of every photo you upload. By submitting a photo, you grant us a limited, single-use license to process that photo through our AI pipeline for the purpose of generating your analysis. This license ends the moment the analysis completes.

Service availability

We strive for high uptime but make no guarantees. The Service may be unavailable due to maintenance, provider outages, or factors beyond our control. Paid users affected by sustained outages may request a refund per the section above.

Disclaimer of warranties

The Service is provided “as is” without warranty of any kind, express or implied. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that AI results are accurate, complete, or useful.

Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the preceding twelve months (or $5.00 if you haven't paid). We are not liable for indirect, incidental, or consequential damages.

Termination

You may stop using the Service at any time. We may terminate your access if you violate these terms, if required by law, or if the Service is discontinued. In the event of discontinuation, we'll provide reasonable notice and prorated refunds where practical.

Changes to these terms

We may update these terms from time to time. If changes are material, we'll update the “last updated” date and notify users in-app where reasonable. Continued use after changes constitutes acceptance.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in California.
